Terms of Service

These terms govern your use of Kuwa, a workforce management and attendance tracking platform operated by Apex Dap Group Ltd (Company No. CS110740526), registered in Ghana. By creating an account or using the platform, you agree to these terms.

Who we are

Kuwa is owned and operated by Apex Dap Group Ltd, a company registered in Ghana with Company Registration Number CS110740526 and TIN C0067366600. References to 'we', 'us' or 'Kuwa' in these terms mean Apex Dap Group Ltd.

Your account

You must provide accurate business and contact details when you sign up, and keep them up to date. You are responsible for keeping your login credentials safe and for any activity that happens under your account. Tell us straight away if you think someone else has access to it.

Acceptable use

You agree to use Kuwa for lawful business purposes only. You will not use the platform to break Ghanaian law, infringe anyone's rights, upload harmful code, attempt to bypass security controls, or reverse engineer the service. You are responsible for the staff, branch and attendance data you add and for making sure you have the right to add it.

Employee data and consent

If you record attendance, location, photos or other personal data about your staff through Kuwa, you are the data controller for that information. You must let your staff know what you are collecting and why, and follow applicable employment and privacy regulations in Ghana.

Billing and payments

Paid plans renew monthly unless you cancel. Prices are shown in GH₵. Payments are processed through our payment partners. If a payment fails, we may suspend paid features until it is resolved. You can cancel any time from your settings, and we will keep your data on file so you can export it.

Refunds

We do not offer refunds for partial months. If something goes seriously wrong on our side, contact us at hello@kuwa.boafo.digital and we will sort it out fairly.

Your data

Your business and staff data belongs to you. We process it on your behalf to run the service. You can export it at any time. We will not sell it or share it with third parties for marketing. See our Privacy Policy for full details.

Service availability

We work hard to keep Kuwa running and to back up your data, but we cannot promise 100% uptime. Planned maintenance, third-party outages and network issues can interrupt service. We will let you know when something goes wrong and fix it as quickly as we can.

Changes to the service

We will keep improving Kuwa, which means features can change, be added or be retired over time. If a change materially reduces what you signed up for, we will give you reasonable notice.

Suspension and termination

We may suspend or close an account that breaks these terms, that we reasonably believe is being used for fraud, or where payment is significantly overdue. You can close your account at any time. After closure we will keep your data for a short period so you can recover it, then delete it.

Liability

Kuwa is provided on an 'as is' basis. To the fullest extent allowed by law, our total liability to you in any 12-month period is limited to the fees you paid us in that period. We are not liable for indirect or consequential losses such as lost profit or lost business.

Governing law

These terms are governed by the laws of Ghana. Any disputes will be handled by the courts of Ghana.

Changes to these terms

We may update these terms from time to time. If a change is material, we will tell you by email or in-product notice before it takes effect. Continued use of Kuwa after that means you accept the updated terms.
